Terms of Service

Welcome to To Kindle. These Terms of Service ("Terms") govern your use of our website, web application, Chrome extension, Firefox extension, Android application, and API (collectively, the "Service"), operated by To Kindle (tokindle.in) ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Acceptance of Terms

By accessing and using To Kindle, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this Service.

2. Description of Service

To Kindle lets you:

  • Send web articles to your Kindle as EPUB files
  • Download the same EPUB without sending it
  • Upload documents for conversion: PDF on the free tier; PDF, EPUB, DOCX or MOBI on Premium
  • Receive digests and schedule sends for later
  • Browse Discover, a daily feed of articles you can send or preview

Our Service processes content from publicly available websites and reformats it for optimal reading on e-reader devices.

3. User Responsibilities

As a user of To Kindle, you agree to:

  • Use the Service only for personal, non-commercial purposes
  • Respect the intellectual property rights of content creators
  • Only process content you have the right to access and use
  • Not use the Service to distribute copyrighted material without permission
  • Not attempt to circumvent any usage limitations
  • Not use the Service for any illegal or unauthorized purpose
  • Provide accurate information when required

4. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority where you live, you need your parent or guardian's permission to use the Service or buy Premium. By using the Service you confirm that you meet these requirements.

5. Usage Limitations

To ensure fair usage and service availability for everyone, we apply usage limits and rate limiting. The current free and Premium limits are published at tokindle.in/pricing and may change.

These limitations apply consistently across the website, the Chrome and Firefox extensions, and the Android app, and may change over time to keep the Service running well for everyone.

6. Intellectual Property

The To Kindle service, including its original content, features and functionality, is and remains the exclusive property of To Kindle and its licensors.

Users retain all rights to the content they submit for processing. We do not claim ownership of articles, PDFs or other content you process through our Service.

Our Service respects the intellectual property rights of others. If you believe that content processed or shown through the Service, including in Discover, infringes your copyright, email tokindle@icloud.com with: the work concerned; where it appears in the Service; your contact details; and a statement that you own the rights or are authorised to act for the owner. We will review your notice and remove or block the content where appropriate.

7. Privacy and Data Handling

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

Key points regarding data handling:

  • We keep a record of each item you send, download or upload, including its title, web address or file name, and the Kindle address it went to, so you can see your history.
  • Files you upload and files we build are removed from our server by a daily clean-up, once they are more than an hour old.
  • A page copy kept for a scheduled send is deleted within 7 days, or sooner once the send finishes or fails.
  • We do not sell your information, and we share it only with the providers named in our Privacy Policy, or where the law requires it.

8. Premium

To Kindle offers a paid tier, Premium, bought through Buy Me a Coffee. The price is the total shown at Buy Me a Coffee's checkout before you pay. Each coffee adds one calendar month of Premium; if you buy while Premium is already active, the new month is added to what you have left, and purchases stack. Premium is a one-time purchase: nothing auto-renews, and you will not be charged again unless you choose to buy again. Premium is matched to your account by the email address you use at checkout; if that differs from your To Kindle email, contact us and we will link them. Premium's specific limits and supported formats are the ones published at tokindle.in/pricing at the time of your purchase.

Refunds. If you are not happy with Premium, email tokindle@icloud.com within 14 days of buying it and we will refund you in full; the Premium time from that purchase is removed from your account. After 14 days, purchases are not refundable unless Premium did not work as described, or the law where you live gives you a right to a refund. This does not affect your statutory rights as a consumer.

9. Service Availability

We strive to maintain high service availability, but we do not guarantee that the Service will be available 100% of the time. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical difficulties
  • Third-party service dependencies
  • Circumstances beyond our control

We may change, suspend or discontinue any part of the Service. If a change materially reduces what Premium includes, or we discontinue the Service, we will give reasonable notice where we can and refund the unused part of your Premium in proportion to the days remaining.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF PROCESSED CONTENT
  • UNINTERRUPTED OR ERROR-FREE SERVICE OPERATION
  • SECURITY OF DATA TRANSMISSION

Nothing in this section affects any rights you have as a consumer that cannot be excluded by contract, including the right to a service provided with reasonable care and skill.

11. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or for anything else that cannot be excluded or limited under the law that applies to you, including your statutory rights as a consumer. Subject to that:

IN NO EVENT SHALL TO KINDLE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damage resulting from your access to or use of, or inability to access or use, the Service
  • Any conduct or content of any third party on the Service

Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us, if any, for using the Service.

12. Your Responsibility

You agree to compensate us for reasonable losses and costs, including reasonable legal fees, arising from a third-party claim, to the extent the claim is caused by your breach of these Terms, your breaking the law, or content you submit that infringes someone else's rights. This does not limit any rights you have as a consumer under the law that applies to you.

13. Termination

You can stop using the Service at any time and ask us to delete your account, as explained in our Privacy Policy. We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect the Service or other users. Unless urgent action is needed, we will email you first and give you a chance to put things right.

If we close your account for any reason other than your breach, or we discontinue the Service or Premium, we will refund the unused part of any Premium you paid for, in proportion to the days remaining. Sections 6, 10, 11, 12 and 14 continue to apply after termination.

14. Governing Law

These Terms shall be interpreted and governed by the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of India. If you are a consumer resident elsewhere, you also keep the protection of the mandatory laws of the country where you live, and nothing in this section limits your rights under India's Consumer Protection Act, 2019 or an equivalent law that applies to you.

15. Changes to Terms

We may update these Terms to reflect changes to the Service, the law or how we run it. If a change is material, we will email you at least 30 days before it takes effect. A change will not reduce what you get from Premium you have already bought. If you do not agree to a change, you can stop using the Service and delete your account before it takes effect. If you keep using the Service after the change takes effect, the updated Terms apply to you.
